The New York State Labor Law exposes property owners and general contractors to significant liability. Often, this liability is vicarious and absolute. These factors present challenges in the representation of our clients. In meeting these challenges, we utilize our extensive experience to obtain risk transfer via third-party contractual indemnification claims and declaratory judgment actions. Where risk transfer is not available, we vigorously pursue available defenses, including recalcitrant worker and sole proximate cause, resulting in the disposal of many cases via summary judgment.

Recognizing the importance of the potential impact of a worker's future wage loss claims, the firm is adept at utilizing economic, vocational rehabilitation, and medical experts to mitigate them. That expertise results in the resolution of matters, prior to trial, which minimizes or eliminates exposure.
