The injured person’s healthcare provider (assignee) filed an arbitration proceeding against our client for first-party medical benefits provided after several automobile accidents. The healthcare provider sought to recover its facility charges for knee surgery purportedly related to a motor vehicle accident involving a vehicle insured by our client.
We argued that the medical treatment in issue was not causally related to the accident involving our client’s insured vehicle, but rather related to a prior accident. The arbitrator agreed, finding that the carrier insuring the vehicle in the earlier accident was solely responsible for the healthcare provider’s bills.
