The New York State Labor Law exposes property owners and general contractors to significant liability.  Often, this liability is vicarious and absolute.  These factors present challenges in the representation of our clients.  In meeting these challenges, we utilize our extensive experience to obtain risk transfer via third-party contractual indemnification claims and declaratory judgment actions.  Where risk transfer is not available, we vigorously pursue available defenses, including recalcitrant worker and sole proximate cause, resulting in the disposal of many cases via summary judgment.

Recognizing the importance of the potential impact of a worker's future wage loss claims, the firm is adept at utilizing economic, vocational rehabilitation and medical experts to mitigate them.  That expertise results in resolution of matters, prior to trial, which minimizes or eliminates exposure.

Malapero & Prisco has successfully litigated complex construction cases at trial.  We are fully versed in the complicated risks of the work site, including the interactions between the various trades, subcontractors, general contractors and the owner, as well as the insurance complications that can arise when an accident occurs.

As a result of our outstanding achievements in this field, Turner Construction Company named us Law Firm of the Year.  All defense matters stemming from the construction of the new Yankee Stadium by Turner Construction, a multi-year project, were assigned to and litigated by the law firm of Malapero & Prisco.
