PIP/No-fault Arbitration

The injured person’s healthcare provider (assignee) filed an arbitration proceeding against our client for first party medical benefits provided after several automobile accidents.  The healthcare provider sought to recover it’s facility charges for knee surgery purportedly related to a motor vehicle accident involving a vehicle insured by our client. We argued that the medical treatment in issue was not causally related to the accident involving our client’s insured vehicle, but rather related to a prior accident.  The arbitrator agreed, finding that the carrier insuring the vehicle in the earlier accident was solely responsible for the healthcare provider’s bills.
